MOVETES LLC (“MOVETES”, “we” “our” “us”) and its affiliates are committed to respecting your privacy. This privacy policy describes how MOVETES uses and protects any information that you provide when you use this website and our mobile site. MOVETES is committed to ensuring that your privacy is protected. This information is used to improve your shopping experience and communicate with you about our products, services and promotions. Neither your name nor anything about you is sold to any other non-affiliated company or agency. However, as described in greater detail below, we may share information under certain circumstances with business partners that help this site function or assist us in fulfilling your order. Should we ask you to provide certain information by which you can be identified when using this website, you can be assured that it will only be used in accordance with this Privacy Policy. MOVETES may change this policy from time to time by updating this page.  

This policy does not apply to practices of companies whose websites may be linked to movetes.com. For access to the privacy policies of such linked websites, please refer to the information provided by such websites on their home pages.

What We Collect

     We may collect the following information: name, contact information, including email address, payment information, demographic information such as region or postal code, preferences, interests, and other information relevant to customer service and offers that aim to improve your experience using this site.

What We Do With The Information We Gather

MOVETES collects personally identifiable information when you request information from movetes.com, make a purchase from movetes.com, when you create an account on movetes.com, when you interact with customer service and through marketing materials. On such occasions, movetes.com may ask for your name, email address, account number, zip code, credit card number and other personal information concerning your interests, occupation, gender and other demographic information. MOVETES also receives and records information from server logs from your browser including cookie information relating to pages requested.

MOVETES does not seek to collect such information from persons under the age of 18. If you are under the age of 18, please do not submit any such information to us. I     f you are the parent or guardian of a person under the age of 18 who has provided such information to us, please inform us (through the movetes.com website or telephone number listed above) and we will remove such information from our database as described further below.


In addition, no person (of any age) is required to provide us with the personally identifiable information we request. If you do not wish to provide such information, you are free not to do so, however, certain aspects of the site may not function properly. Your provision of requested information to us through MOVETES’ website or other means is presumed by us to be voluntary and with your consent to the uses described herein. If after submitting personally identifiable information to us, you wish to "opt-out," please contact us at the telephone number or e-mail listed in this privacy policy and we will remove your information from our database. Please note that such a decision will not stop advertising or content that is generated prior to the time when we can accomplish the removal of your information and it may take thirty (30) days to complete this process. 

We require this information to understand your needs and provide you with a better service and to improve our products, services and overall shopping experience. We use this information for our internal record keeping and to conduct transactions with you. We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided. From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, text, phone, or mail. We may use the information to customize the website according to your interests. We use this information for preventing and detecting fraud and abuse. We use this information to enable our service providers to perform certain activities on our behalf, including complying with our legal obligations, policies and procedures for internal administrative and analytics purposes.

MOVETES will not sell or rent your personally identifiable information to any third party except when:

  • We must share the information in order to provide a product or service that you have requested, in which case we will demand that any third party we use to fulfill your order agree that it does not have the right to use the personally identifiable information other than to fulfill your request; or
  • When we are required to respond to subpoena, court orders or other legal process requiring such disclosure, including, but not limited to enforcing this privacy policy and the terms of use, for crime-prevention purposes, or to protect against misuse or unauthorized use of movetes.com.

You may choose to enable, log into, or sign on to MOVETES-branded social media websites such as Facebook, Instagram, or Twitter (“Social Networking Services” or “SNS”). when you connect using your SNS accounts, we may collect personal data that you have provided to that SNS. For      example, when you log in with your Facebook credentials, with your consent, we may collect personal data from your Facebook profile that is permitted under Facebook’s Terms of Use – such as your email address, profile picture, and friend list. We use this data to provide, enhance, and personalize the services we provide to you. If you do not want to provide us with this information, please change the privacy settings on your SNS account.

How We Use Cookies

The website may use cookies to enhance the browsing experience and user experience on the webpage. Cookies help us provide you with a better experience by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline a cookie. A cookie is a small file which asks permission to be placed on your computer’s hard drive. These companies may collect information about your visits to movetes.com, and your interaction with our advertising and other communications. We may combine the information we collect through cookies and pixel tags with other information we have collected from you. This information may be used to improve movetes.com, to personalize your online experience, to help us deliver information to you, to determine the effectiveness of our advertising, and for other internal business purposes.

We maintain MOVETES-branded pages on various social networking services. When you visit these sites, the site’s provider and other third parties may set cookies and other tracking technologies on your browser or device.  

We will not sell your personal data to any third party.

Security

Your personal data may be stored, transferred and processed in the United States and in other countries by our affiliates and/or service providers. The data protection laws in these countries may provide a lower standard of protection for your personal data than your country of residence. We take great care in protecting your personal data and have put in place adequate mechanisms to protect it when it is transferred internationally. We will transfer your personal data in compliance with applicable data protection laws and will implement suitable safeguards to ensure that your personal data is adequately secured by any third party that will access your information.

By using movetes.com and providing personal data, you consent to the terms of this Privacy Policy and the collection, use, maintenance, transfer to and processing of your personal data in the United States or other countries or territories, and, unless otherwise stated in this Privacy Policy, we will use this consent as the legal basis for that data transfer.

MOVETES uses commercially reasonable measures to keep your personal data private and safe. We take appropriate physical, electronic and administrative steps to maintain the security of personal data we collect, including limiting the number of people who have physical access to our servers, as well as employing electronic security systems and password protections that guard against unauthorized access. In addition, it is our policy to never send your payment card number via email. Please note, however, that email is not encrypted and is not considered to be a secure means of transmitting payment card information.

We use industry standard security technology in transferring information to process your orders. All payment card transactions should take place in protected areas of movetes.com, which are designed to reduce the risk of any loss, misuse or alteration of the information collected. When you begin the checkout process, you should move into such a protected area. 

Despite our best efforts, the transmission of data over the Internet cannot be guaranteed to be 100% secure. While we use commercially reasonable means to ensure the security of information you transmit to us, we cannot guarantee that such information will not be intercepted by third parties. We may, however, prosecute any unauthorized or fraudulent transactions to the fullest extent permitted by law.

California Privacy Rights: 

The California Consumer Privacy Act (“CCPA”), which provides California consumers certain rights regarding their Personal Information as those terms are defined in the CCPA, became effective on January 1, 2020. 

We are providing you with notice of the personal information we collect and our purposes for that collection for data that may be subject to the CCPA (“CCPA Notice”). This CCPA Notice does not cover information that is outside of the scope of the CCPA. This notice also does not apply to data collected from employees, applicants or contractors or to data collected from individuals acting as representatives of another business in connection with business communications or transactions.

We collect personal information directly from you, your device or browser, our service providers and suppliers, and our corporate affiliates. We use and share personal information for the following business purposes: 

  • to provide requested products and services;
  • to advertise and offer new products and services;
  • to improve our products and services;
  • for quality assurance;

  • for prevention of fraud and illegal activity; and
  • for marketing purposes.

  • inferences from personal information collected (e.g., your preferences, your likelihood of interest in certain of our services).
  • we collect the following categories of personal information from consumers, which we only share with our affiliates:
  • Internet usage information (e.g., information regarding your interaction with our online services);
  • geolocation data (e.g., if you enable this feature on your device while using our app); and sensory data (e.g., recordings of customer service calls, store security camera footage)

If you are a California consumer and would like to register a request under your “right to know about personal information collected, disclosed or sold” (including right to obtain copies of specific pieces and/or information about categories of personal information practices), “right to request deletion of personal information,” or “right to opt-out of the sale of personal information,” or if you have questions about our privacy policies or practices, you can contact us at info@movetes.com. You have the right to not receive discriminatory treatment in a manner prohibited by the CCPA as a result of your exercising your rights under the CCPA.

To fulfill your CCPA request, we may require you to provide sufficient information to reasonably verify you are the consumer about whom we collected personal information. This verification process includes providing us at least two (2) unique data points, depending on the type of request.

Consumers have the right to exercise CCPA privacy rights via an authorized agent who meets the agency requirements of the CCPA.  Authorized agent requests must include a copy of the agency agreement between the authorized agent and the consumer. We will ask the consumer to independently confirm the agency relationship. 

California residents are entitled to ask us for a notice describing what categories of personal data we share with third parties or corporate affiliates for those third parties’ or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please see the “How To Contact Us” section below for where to submit a request. Please allow thirty (30) days for a response.

The Right to Know

You have the right, subject to statutory exceptions, to send us a request, no more than twice in a twelve-month period, for any of the following information for the period that is twelve months prior to the request date:

  • The categories of personal information we have collected about you.
  • The categories of sources from which we collected your personal information.
  • The business or commercial purposes for our collecting or selling your personal information.
  • The categories of third parties to whom we have shared your personal information.
  • A list of the categories of personal information disclosed for a business purpose in the prior 12 months, or that no disclosure occurred.

You have the right, subject to statutory exceptions, to make or obtain a transportable copy, no more than twice in a twelve-month period, of your personal information that we have collected in the period that is 12 months prior to the request date and are maintaining. 

The Right to Deletion

You have the right, subject to statutory exceptions, to request that we delete your personal information that we have collected directly from you and are maintaining.  Note also that we are not required to delete your personal information that we did not collect directly from you. 

You may alternatively exercise more limited control of your personal information by canceling or modifying the email marketing communications you receive from us. You can do this by following the instructions contained in our promotional emails.

The Right to Opt Out of Sale of Personal Information

We do not “sell” personal information that we collect from you, including personal information of minors under the age of 18, as “sell” is defined in the CCPA. However, we treat all personal information that we collect from you as subject to a “do not sell” request. 

We do work with service providers and partner with advertising companies that use cookies and other tracking technologies to collect information about your visits to our website and third-party sites, and then use that information to deliver advertisements relevant to your interests.

For more information on how we use cookies and other tracking technologies, please review the above sections of our Privacy Policy.  There is not yet a consensus as to whether third party cookies and tracking technologies associated with our websites and mobile apps constitute a “sale” of your personal Information as defined by the CCPA. If you clear the cookies on your device, you may need to set your cookie preferences again.

Miscellaneous

This Privacy Policy and our legal obligations are subject to the laws of the State of Florida and the USA, regardless of the location of any user. Any claims or complaints must be filed in the USA in the State of Florida. You hereby irrevocably waive any right you may have to a trial by jury in any action, dispute or proceeding.

You have the option to opt out of receiving information from MOVETES and movetes.com. This opt out message will appear at the bottom of every email that is sent out. If you no longer wish to take advantage of movetes.com or receive any form of direct contact from MOVETES or movetes.com, whether it is e-mail, discounts, newsletters or other promotional offers or materials, please contact us at info@movetes.com.
